Terms of Service

These terms govern your use of Mercantle. By creating an account or using the service, you agree to them. If you're using Mercantle on behalf of a company, you agree on its behalf.

The service

Mercantle is a revenue operating system for Shopify app makers, analytics, billing recovery, a health CRM, affiliate software, a marketplace, and AI insights. We may add, change or remove features over time.

Your account

You're responsible for your account and for keeping your credentials secure. Provide accurate information and let us know if you suspect unauthorized use.

Acceptable use

Don't misuse the service: no attempts to breach security, disrupt the platform, reverse-engineer it, or use it to violate the law or others' rights. Don't connect data you don't have the right to connect.

Billing & plans

Paid plans are billed in advance on a recurring basis. You can upgrade, downgrade or cancel at any time; changes take effect per your plan and we prorate where applicable. Fees are non-refundable except where required by law.

Your data

Your data is yours. You grant us the rights needed to operate the service for you, as described in our Privacy Policy. Our Partner connection to your revenue data is read-only, and you can revoke it at any time. Optional features — such as the SDK/ingest API and the Google Analytics connection — process data you choose to send or connect, and you're responsible for having the right to send it.

Affiliate programs & marketplace

Mercantle provides ledgering and tracking tools for affiliate programs — we record referrals, commissions and payout status, but we never hold, transmit or pay out funds. Mercantle is not a payment processor or money transmitter. Studios are solely responsible for paying their affiliates, for the terms of their programs, and for obtaining any consents required for emails they send to their merchants or affiliates. Mercantle is not a party to any studio–affiliate or studio–merchant relationship.

Affiliates

If you use the free affiliate workspace, you agree to promote programs accurately, and not to generate self-referrals or fraudulent traffic. Studios may reverse commissions for fraud in accordance with their program terms.

Intellectual property

Mercantle and its software, design and content are owned by us. These terms don't transfer any of our intellectual property to you beyond the right to use the service.

Disclaimers

The service is provided “as is.” Mercantle helps you understand and act on your revenue, but it isn't financial, legal or tax advice, and we don't guarantee specific outcomes.

Limitation of liability

To the extent permitted by law, Mercantle isn't liable for indirect or consequential damages, and our total liability is limited to the fees you paid us in the twelve months before the claim.

Termination

You can stop using Mercantle and delete your account at any time. We may suspend or terminate accounts that violate these terms. On termination, your right to use the service ends and we handle your data per our Privacy Policy.

Changes

We may update these terms as the service evolves. Material changes will be reflected here with a new “last updated” date; continued use means you accept them.

Mercantle is located at 1309 Coffeen Ave, Sheridan, WY 82801, United States. These terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules.
